Service Terms

In the following terms, "User" refers to an individual or entity that applies to Hong Kong Cloud to register as a member.

 

The User agrees that the validity of these online registration terms is the same as that of a written agreement signed and sealed by the User in person, and these terms are legally binding on the User. The User further agrees that entering the Hong Kong Cloud member registration process means that the User agrees to all the contents of these registration terms, and only when the User fully agrees to all the service terms and completes the registration process can the User become an official member of Hong Kong Cloud. These registration terms come into legal effect between the User and Hong Kong Cloud from the date of successful registration by the User.

 

Article 1: Introduction to Hong Kong Cloud Services
Hong Kong Cloud provides its member users with Internet technical services and network services, including domain name registration and website hosting services. For detailed descriptions of the relevant services provided by Hong Kong Cloud, please refer to the product and service introductions on the relevant website.

 

Article 2: User Identity Guarantee
2-1 The User undertakes and guarantees that he/she/it is a natural person, legal person, entity or organization with full capacity for civil conduct and full capacity for civil rights. The User hereby guarantees that the user information filled in is true, accurate, complete and up-to-date, and contains no misleading or false statements, and guarantees that Hong Kong Cloud can contact the User through the contact information filled in by the User.
2-2 The User shall provide the corresponding identity certificates and other materials in a timely manner according to the requirements of Hong Kong Cloud for the relevant services. Otherwise, Hong Kong Cloud has the right to refuse to provide relevant services to the member or User.
2-3 The User undertakes to update his/her/its user information in a timely manner to maintain the validity of such information.
2-4 If the materials or information provided by the User contains incorrect or untrue information, Hong Kong Cloud reserves the right to cancel the User's membership and terminate the provision of services to the User at any time.
2-5 When registering on behalf of other natural persons or entities as an agent, the User must provide Hong Kong Cloud with detailed materials and information about the agent and the principal, as well as the written authorization document. If the above materials, information and documents are not provided to Hong Kong Cloud, Hong Kong Cloud will regard the registrant as a member.

 

Article 3: Email Notification
The User fully understands that Hong Kong Cloud will keep in touch and communicate with the registered members via email. The User hereby agrees that Hong Kong Cloud may send relevant commercial and non-commercial contact information, including member information, information about Hong Kong Cloud's products and services, to the User via email.

 

Article 4: Member Identity Confirmation
4-1 After successful registration, the User will obtain a username and password, and the User can enjoy the products and services provided by Hong Kong Cloud to its member users with the username and password.
4-2 The User shall be fully responsible for the security of the username and password, and shall be fully responsible for all activities and events carried out under the username. The User has the right to modify the password using the procedures provided by Hong Kong Cloud at any time.
4-3 Without the written consent of Hong Kong Cloud, the username and password shall not be transferred or authorized for use by others. Otherwise, the User shall bear all the consequences arising therefrom. Hong Kong Cloud supports the transfer of products to other members of the platform.
4-4 If the User discovers any illegal use of the User's account or the existence of security vulnerabilities, the User shall immediately notify Hong Kong Cloud.

 

Article 5: Modification of Service Terms and Revision of the Service System
Hong Kong Cloud has the right to modify the service terms when necessary. Once the Hong Kong Cloud service terms are changed, the modified content will be prompted on important pages. If the User does not agree with the changes, the User may actively cancel the obtained network services. If the User continues to use the network services provided by Hong Kong Cloud, it shall be deemed that the User accepts the changes to the service terms. Hong Kong Cloud reserves the right to modify its service system and prices without notifying the User. If the User has reached an agreement with Hong Kong Cloud on specific services and has paid the fees as agreed before Hong Kong Cloud modifies its service and price system, Hong Kong Cloud will execute the agreement until the expiration of the service period for which the fees have been paid. The price increase of Hong Kong Cloud products will not affect the renewal price for existing users.

 

Article 6: User's Rights and Obligations
6-1 The User has the right to own his/her/its username and password on Hong Kong Cloud and has the right to log in to the member area of the Hong Kong Cloud website with the username and password at any time.
6-2 The User has the right to enjoy the Internet technical and information services provided by Hong Kong Cloud, and has the right to obtain technical support, consultation and other services from Hong Kong Cloud when accepting the services provided by Hong Kong Cloud. For detailed service contents, please refer to the relevant product introductions of Hong Kong Cloud.
6-3 The User guarantees that he/she/it will not use technical or other means to damage and disrupt the Hong Kong Cloud website and the websites of other Hong Kong Cloud customers. If the server without defense is affected by a DDoS attack and affects the network of other customers' servers, Hong Kong Cloud will directly block the IP for 24 hours. In case of serious circumstances, the User will be asked to leave and no refund will be given.
6-4 The User shall respect the intellectual property rights and other legal rights of Hong Kong Cloud and other third parties, and guarantee to make every effort to protect Hong Kong Cloud, its shareholders, employees, partners, etc. from being affected or suffering losses due to such events. Hong Kong Cloud reserves the right to terminate the provision of services to the User and not refund any payments when the User infringes upon the intellectual property rights of Hong Kong Cloud.
6-5 The User shall bear all the consequences caused by incorrect contact information provided to Hong Kong Cloud and the poor security and stability of the email box used by the User to receive emails from Hong Kong Cloud, including but not limited to the consequences and losses caused by the User's failure to receive relevant notifications from Hong Kong Cloud in a timely manner. For example, using a Google mailbox may prevent the User from receiving important information sent by the platform in China.
6-6 The User guarantees that when using the services provided by Hong Kong Cloud, he/she/it will comply with national and local laws, regulations, industry practices and social public ethics, and will not use the services provided by Hong Kong Cloud to store, publish or disseminate the following information and content:
6-6-1 Any content (information) that violates national laws and regulations;
6-6-2 Political propaganda or news information that violates national regulations;
6-6-3 Information involving national secrets or security;
6-6-4 Feudal superstition, pornographic, vulgar information or information inciting crime;
6-6-5 Lottery and gambling games;
6-6-6 Information that violates national ethnic and religious policies;
6-6-7 Information that hinders the security of the Internet operation;
6-6-8 Information that infringes upon the legitimate rights and interests of others or other information or content that is detrimental to social order, public security and public ethics.
The User also undertakes not to provide any convenience for others to publish the above information content that does not comply with national regulations or the provisions of these service terms, including but not limited to setting URL, BANNER links, etc. The User acknowledges that Hong Kong Cloud has the right to terminate the provision of services to the User and not refund any payments when the User violates the above provisions. If the User causes losses to Hong Kong Cloud due to the above behaviors, the User shall compensate for the losses.
6-7 The User has the obligation to pay the fees as agreed. The relevant products will be suspended and automatically deleted within 5 minutes after the product expires, and Hong Kong Cloud will not bear any responsibility for the resulting losses. If the User fails to pay the fees until the last second of the product expiration, it will be deemed that the User has automatically abandoned the relevant products or services. We will only retain the expired products for a maximum of 5 minutes. If it is impossible to pay the fees due to special circumstances, the User must contact our staff.
6-8 Regarding the right of refund without reason, the cloud server only supports a 24-hour refund without reason. Refunds will not be available for orders exceeding 24 hours (including renewal orders), and no refund will be given for successfully registered domain names.

 

Article 7: Rights and Obligations of Hong Kong Cloud
7-1 Hong Kong Cloud shall provide the User with qualified network technical and information services according to the services selected by the User and the payment made by the User.
7-2 Hong Kong Cloud undertakes to take confidentiality measures for the User's information and not disclose the User's information to third parties, nor authorize third parties to use the User's information, except in the following cases:
7-2-1 It can be provided in accordance with the provisions of these agreement terms or other service agreements, contracts, online terms, etc. between the User and Hong Kong Cloud;
7-2-1 It should be provided in accordance with the provisions of laws and regulations;
7-2-3 It is required to be provided by the administrative, judicial and other competent departments;
7-2-4 The User agrees to Hong Kong Cloud providing the information to third parties;
7-2-5 It is submitted by Hong Kong Cloud for resolving reported incidents or filing lawsuits;
7-2-6 It is necessary to be submitted by Hong Kong Cloud for taking necessary and reasonable actions to prevent serious illegal acts or suspected criminal acts;
7-2-7 It is provided by Hong Kong Cloud to third parties for providing products, services and information to the User, including the situation where Hong Kong Cloud provides products, services and information to the User through the technology and services of third parties.
7-3 Hong Kong Cloud has the right to use the personal information submitted by the User (only for resolving some technical problems submitted by the User across internal departments, and third-party service providers cannot view any information of the User).
7-4 Hong Kong Cloud has the right to review the User and decide whether to accept the User as a member of Hong Kong Cloud or whether to conduct a certain transaction with the User.
7-5 Hong Kong Cloud reserves the right to terminate the provision of services to the User and terminate the User's account when the User violates national and local laws and regulations or these online registration terms. In any case, Hong Kong Cloud shall not be liable for any indirect, accidental, special or consequential damages.

 

Article 8: Termination of Services and Liability for Breach of Contract
8-1 The User has the right to apply for the termination of his/her/its membership or one or more services applied for by the User on Hong Kong Cloud at any time, but the paid fees shall not be refunded.
8-2 Hong Kong Cloud has the right to decide to cancel one or more services provided to the User according to the actual situation, but shall refund the remaining part of the fees paid by the User for the services, and Hong Kong Cloud shall not bear any other responsibilities.
8-3 If the User's fault, violation of laws or these online terms and other reasons occur, Hong Kong Cloud may terminate the services in advance after notifying the User. If the User's network resources are frequently affected by DDoS attacks, which affects other users, it is the User's responsibility. Currently, regardless of whether it is a large or small manufacturer in the market, if a DDoS attack occurs, the IP will be blocked for a certain period of time. Hong Kong Cloud will block the IP for 2 hours each time, and the blocking time will increase exponentially according to the number of attacks. We have opened a self-service query platform at https://dd.cn2.hk/. Please do not tell us how important your business is, as no one's business is unimportant. In case of serious circumstances, we will terminate the services and no refund will be given.
8-4 If the User suffers losses due to the reasons of Hong Kong Cloud, Hong Kong Cloud shall compensate the User with the monthly rent of the current product as the upper limit. The User fully understands that Hong Kong Cloud shall not be liable for any delays or losses caused to the User due to network failures of Hong Kong Cloud (the international Internet link may be volatile, unstable and experience packet loss) and server failures (all electronic products may malfunction, but our engineers will solve the problems as quickly as possible after they occur).
8-5 After applying to become a member of Hong Kong Cloud, the User shall comply with the resolutions on anti-spam emails made by Hong Kong Cloud. The User undertakes not to use the servers of Hong Kong Cloud for any spam-related behaviors, including but not limited to sending spam emails using the servers of Hong Kong Cloud; the relevant information of the Hong Kong Cloud servers or IP addresses is included in the spam emails sent by the User; the User's websites contain content that supports spam services, such as email list sales, email address search software, mass email sending software, etc.; the spam emails sent by the User contain the information of the domain names registered by the User on Hong Kong Cloud and other content or information that may make domestic and international anti-spam organizations believe that Hong Kong Cloud or the users of Hong Kong Cloud are related to spam incidents. The User understands that once a spam incident occurs, it will cause irreparable huge losses to Hong Kong Cloud and all its users. Therefore, Hong Kong Cloud has the right to immediately stop providing any services to the User when the User is involved in spam-related behaviors. Regardless of whether the services enjoyed by the User on Hong Kong Cloud are paid or free, and regardless of whether the services are directly related to the spam-related behaviors, Hong Kong Cloud has the right to cancel the User's membership and reserve the right to claim compensation for the losses caused to Hong Kong Cloud by the User's involvement in spam incidents.
8-6 Resource abuse: For virtual servers, in order to ensure the user experience, we do not impose excessive restrictions on the User's use. However, if there is resource abuse, such as continuously occupying a certain resource at 100% for a long time, such as CPU and bandwidth, the platform will automatically limit the CPU performance or bandwidth speed of the User. The most obvious feeling for the User is that the server becomes slow. Contacting the customer service can lift the restriction. If the User uses resources in excess of the limit multiple times, the User will be asked to leave.
8-7 The User acknowledges that Hong Kong Cloud has the right to determine whether the content published by the User constitutes a violation of the service terms or relevant national regulations based on Hong Kong Cloud's own prudent judgment. The User undertakes to adjust the content on the User's website to comply with national regulations or the provisions of these service terms after receiving a notice from Hong Kong Cloud. Otherwise, Hong Kong Cloud has the right to terminate the provision of services. If the services are terminated due to illegal activities or potential losses to Hong Kong Cloud, no refund will be given.

 

Article 9: Dispute Resolution and Applicable Law
9-1 All disputes related to these service terms shall be resolved by the parties through friendly negotiation. If the negotiation fails, both parties agree to file a lawsuit with the people's court in the main business location (Donghu New Technology Development Zone, Wuhan) of Hong Kong Cloud.
9-2 The validity, interpretation, performance and dispute resolution of these registration terms shall be governed by the laws, regulations of the People's Republic of China and the norms of the computer and Internet industry.

 

Article 10: Force Majeure
10-1 If due to force majeure or other accidental events, the performance of these terms becomes impossible, unnecessary or meaningless, the party suffering from force majeure or accidental events shall not be liable.
10-2 Force majeure and accidental events refer to objective events that cannot be foreseen, overcome and avoided and have a significant impact on one or both parties, including but not limited to natural disasters such as floods, earthquakes, plagues and storms, as well as social events such as wars, unrest and government actions.
10-3 The User agrees that in view of the 特殊性 of the Internet, hacker attacks, international Internet connection interruptions or system failures, etc. are considered force majeure, and Hong Kong Cloud shall not be liable for any losses caused to the User or third parties as a result.

 

Article 11: Supplementary Provisions
11-1 If any provisions in these registration terms are determined to be invalid by an authoritative institution, it shall not affect the validity of other provisions, nor shall it affect the interpretation of these service terms, the liability for breach of contract and the relevant provisions on dispute resolution.
11-2 If one party changes the notification, communication address or other contact information, it shall promptly notify the other party of the changed address and contact information from the date of the change. Otherwise, the changing party shall bear all the consequences caused thereby. The User agrees that the relevant notifications from Hong Kong Cloud are deemed to be served to the User as long as they are published on the relevant web pages of Hong Kong Cloud.
11-3 In case of events such as the listing of Hong Kong Cloud, acquisition, merger with a third party, name change, etc., the User agrees that Hong Kong Cloud may transfer its rights and obligations to a third-party beneficiary. If you do not agree, you can stop renewing the services after the current service cycle ends.

 

Article 12: Supplementary Instructions
12-1 Hong Kong Cloud has deployed multiple domain names globally. Users need to use specific domain names to access Hong Kong Cloud's business in different regions. Currently, our main business area is China, and we also have a small amount of business being promoted in some cities of other countries. As long as the User's business generates data in China, the User shall comply with the relevant laws and regulations of China.
